BCBC Supports Provincial decision to seek a stay of judgement in Cowichan Case 

The Business Council of British Columbia (BCBC) strongly supports the provincial government’s decision to seek a stay of judgment pending appeal in the Cowichan Tribes v. Canada case. While this step does not provide long-term certainty, it sends an important signal that the province is committed to preventing immediate enforcement of the ruling as the legal process continues. This is a critical measure to help maintain confidence during a period of uncertainty. 

The implications of this decision and the risks to British Columbia’s economy are unprecedented and unfolding in real time. In less than 90 days since the ruling, we have heard from many employers and investors expressing serious concern, with investment decisions already being deferred, paused, or redirected until greater clarity emerges. 

We have encouraged the Province to put forward the strongest possible case on appeal, with a clear focus on the public interest of all British Columbians. It is essential to chart a pragmatic path forward that advances reconciliation and a prosperous future, which includes protecting private property rights.
